Shipping

All orders are delivered to you via Australia Post.

A Flate Fee of $10.95 will be paid for all shipping within Australia. Shipping will be delivered with Express Post once order is recieved and processed by our warehouse.

We deliver Internationally to selected countries only, there is a flat fee for International Shipping of $25. It is your responsibility to pay import duty or sales tax within your own country.

Sale Terms

In these Terms of Service, "we", "us", "our" or "SHOPBYHEART" means HOT $ALE PTY LTD trading as SHOPBYHEART (ABN 14 166 267 303).

We display goods for sale on this website (Website).

If you purchase goods on this Website, the purchase is subject to these terms of sale (Sale Terms) and you agree to the Sale Terms by placing an order.

 

Purchaser requirements

In order to purchase goods you must be 18 years of age or older. If you are under 18 years of age we can accept purchases from your parent or guardian.

When submitting payment information, you must use a valid credit or debit card issued by a bank acceptable to us. Any card you use must be your own or one whose owner has authorised you to make the purchase.

When placing an order you undertake that all details you provide to us are true and accurate, that you are an authorised user of the credit or debit card used to place your order and that there are sufficient funds to cover the cost of the goods.

We only accept orders for personal use (which may include gifting to others). If you wish to purchase for commercial purposes or in commercial quantities, please contact us.

We may refuse any order made by you in our absolute discretion.

 

Delivery

All orders are subject to availability and confirmation of the order price.

Dispatch times may vary according to availability. Any representations made as to delivery times are subject to any delays resulting from postal, shipping and handling delays or force majeure. We make efforts to deliver your goods on time, but we are not responsible for any delays that are caused by factors and/or people outside our control.

If you are purchasing goods outside Australia, you are responsible for importing the goods into the country nominated by you for delivery. If you need purchase confirmation or other assistance from us to import the goods, please contact us.

Sale contract

When you place an order, you will receive an acknowledgement e-mail confirming receipt of your order. This email will only be an acknowledgement and will not constitute acceptance of your order.

By placing an order for any goods on the Website you are offering to purchase the goods. A contract between us and you for the purchase of the goods will be formed when your payment has been approved and our billing agent has debited your credit or debit card. The contract comprises these Sale Terms, your order and our confirmation (acceptance) of your order.

 

Pricing and Availability

Prices of goods displayed on this Website include GST. GST is a goods and services tax imposed by Australian law.

Your credit or debit card issuer may charge currency conversion or other fees on your order. You should check with the issuer for details of any such fees before purchasing.

Delivery costs will be charged in addition to the price of any goods. When you submit your order, we will specify the delivery costs to be added to the purchase price of the goods.

We try to ensure the accuracy of all details, descriptions and prices displayed on this Website However, errors may occur. If we discover a price error on goods you have ordered we will inform you of this and give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you we will treat the order as cancelled. If you cancel and you have already paid for the goods, we will refund you in full.

 

Payment

Payments are processed by PayPal Australia Pty Limited (ABN 93 111 195 389) (Paypal) as our billing agent to invoice and collect payment for the goods. You will see their name on your invoice and on your transaction history if you pay by credit or debit card. Upon receiving your order, PayPal carries out standard pre-purchase checks on your credit or debit card to ensure there are sufficient funds to process the transaction. Goods will be dispatched once pre-authorisation checks have been completed successfully. Your card will be debited once your payment has been approved.Your purchase will be subject to PayPals’ terms and conditions.

 

Discount codes

We may offer discount codes from time to time. Discount codes may only be used on the purchases for which they are applicable. In order to be applied to the purchase, discount codes must be submitted at the time of submitting an order, not after.

We will inform you of any conditions of a discount code, including (without limitation) applicable goods, eligible brands, timing of purchase, price or transaction minimums or maximums, whether multiple codes can be used in conjunction with others in a single purchase.

Out of Stocks 

 We update our site’s product availability multiple times a day however in some very rare instances another customer may have selected to purchase the same item as you at the same time. If this happens, we will notify you within one business day that we will not be able to deliver the goods in the usual delivery period. If it is an item that we cannot re-order – we will give you a refund immediately; if it is an item we can re-order – we will inform you of the new delivery time frame and give you the choice of waiting or receiving a refund.

Faulty goods

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You may be entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You also may be entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

If the goods are faulty, please contact us immediately on the details below. Please include as many details as possible about the order and the problem with the goods. We will respond to your notification as quickly as we can.

Wear and tear is not an indication that goods are faulty and we will not accept returns that are returned due to the effects of reasonable wear and tear.

Change of mind and re-sizing

You can return any goods within 7 days of receipt for a refund of those goods if you no longer want the goods or wish to exchange them for goods of a different size or colour. See the section below for details on the conditions that apply to the return of goods.

Returns generally

All returned goods will be inspected by us on return. All goods must be returned in their original packaging and with tags/labels still attached.

We do not accept returns of goods that have been worn (other than to try the goods for size – when trying on shoes you must do so on a carpeted surface), damaged, altered, separated from the pair or set with which they were delivered or are otherwise not in their original condition. Any stains, odours, rips, tears, bent or damaged goods or tags/labels inspected will be deemed to be changes from original condition and no refund will be given for the returned goods.

Goods may not be returnable if they are supplied with protective items (including hygienic items) that have been removed. Some items such as swimwear, underwear,make-up or earrings are not returnable under any circumstances, unless faulty.

You are responsible for the costs of returning goods to us. Any goods returned are your responsibility until they reach our warehouse. Please ensure you package your return to prevent any damage to the goods or boxes. You are responsible for any damage caused to the goods from the time we originally deliver the goods to you. We recommend that you take out shipping, handling and/or postal insurance on goods you return to us.

To return goods, you must:

within 7 days of receiving the goods (or such time as is reasonable in the circumstances), email customercare@shopbyheart.com.au requesting a return and setting out why you wish to return the goods;

provide additional information requested by us in relation to your return request;

package the returned goods in their original packaging and any other protective packaging required to take good care of the goods;

within 14 days of receiving the goods and packaging them as required, ship the goods by express post (or “priority post” or equivalent) to:

Australian Consumer Law

Nothing in these Terms excludes, restricts or modifies any right, remedy or guarantee implied or imposed by any legislation which cannot lawfully be excluded or limited such as Australian Consumer Law contained in Schedule 2 of the Competition and Consumer Act 2010 (Cth).

General

These Terms are governed by the laws of Victoria, Australia, and any dispute or claim associated with these Terms is subject to the non-exclusive jurisdiction of the courts of Victoria.

These Terms constitute the entire agreement between you and us and supersede any and all other agreements between you and us.

These Terms may be updated by us from time to time.
